Bodily injury coverage pays damages for injuries or death sustained by a person in an auto accident that a covered person causes. It also provides the covered person with a legal defense. Limits of liability apply on an each accident basis. Limits appear as either a per person/per accident limit or as a per accident limit (also known as combined single limit).

If the limits are on a per person/per accident limit, the first number is the most an insurer will pay for damages to any one injured person in an accident. The second number is the most an insurer will pay for damages to all injured persons combined in any one accident. For example, if you bought a policy with bodily injury limits of $50,000/$100,000, the most your insurer would pay any one person is $50,000, and the most the insurer would pay to all injured persons combined is $100,000.

If the limit is a combined single limit, there is one limit for both bodily injury and property damage liability. The limit shown is the most an insurer will pay for damages for all injuries and all damage to property of others due to an accident.

Selecting the right limits is important. If you select limits that are too low, you put yourself at risk financially. For example, if you cause a serious injury where damages exceed your limits, you would have to pay those damages out of your own pocket.

This is meant only as a general description to help you understand bodily injury coverage and limits. It does not refer to any specific insurance policy and it does not modify the limits, terms and conditions of any policy you might purchase. To fully understand all coverages, including applicable limits and exclusions, you should read your policy carefully and discuss any questions with an insurance representative.

In general bodily injury coverage pays damages for injuries or death sustained by a person in an auto accident that a covered person causes. It also provides the covered person with a legal defense. Limits of liability apply on an each accident basis. Limits appear as a per person limit and a per accident limit. For example: $20,000 per person and $40,000 per accident. The per person limit is the most an insurer will pay for damages to any one injured person in an accident. The per accident limit is the most an insurer will pay for damages to all injured persons combined in any one accident.

Selecting the right coverage and limits is important. If you select inadequate coverage or limits that are too low, you put yourself at risk financially. For example, if you cause a serious injury where damages exceed your limits, you would have to pay those damages out of your own pocket.

In Massachusetts there are two coverages that provide bodily injury coverage. The coverages are similar in some ways and different in others. These two coverages are:

Part 1 Bodily Injury To Others; and Part 5 Optional Bodily Injury To Others Part 1 Bodily Injury To Others is one of the Massachusetts compulsory coverages. The coverage is very limited and the only limit available is $20,000 per person and $40,000 per accident. Part 5 Optional Bodily Injury To Others is one of the Massachusetts Optional coverages and broadens the coverage provided under the compulsory Part 1 Bodily Injury To Others.

Under Part 1.Bodily Injury To Others, we will pay compensatory damages to people injured or killed by your auto in Massachusetts accidents. The damages we will pay are the amounts the injured person is entitled to collect for bodily injury through a court judgment or settlement. We will pay only if you or someone else using your auto with your consent is legally responsible for the accident. The only limit available for Part 1 is $20,000 per person and $40,000 per accident. This is the most we will pay as the result of a single accident no matter how many autos or premiums are shown on the Coverage Selections Page.

Among other things, under Part 1 Bodily Injury To Others we will not pay for:

  • Injuries to guest occupants of your auto;
  • Accidents outside of Massachusetts or in places in Massachusetts where the public has no right of access; or
  • Injuries to any employees of the legally responsible person if they are entitled to workers' compensation benefits.

Under Part 5 Optional Bodily Injury To Others, we will pay compensatory damages to people injured or killed in accidents if you or a household member is legally responsible for the accident. We will also pay compensatory damages if someone else using your auto with your consent is legally responsible for the accident. The damages we will pay are amounts the injured person is entitled to collect for bodily injury though a court judgment or settlement.

There are a number of exclusions that apply to Part 5 Optional Bodily Injury To Others. However, unlike Part 1, there are no exclusions for injuries to guest occupants of your auto, simply because they are guest occupants. In addition coverage applies to accidents in places within Massachusetts where the public does not have access and to accidents that occur in other states or Canada.

The limit you purchased is the most we will pay as the result of a single accident no matter how many autos or premiums are shown on the Coverage Selections Page.

If you purchase compulsory Part 1 Bodily Injury To Others and Part 5 Optional Bodily Injury To Others, the limits shown for Part 5 on the Coverage Selections Page are the total limits you will have under both Part 1 and

Part 5. This means that the Compulsory limits in Part 1 are included within the limits shown on the Coverage Selections Page for Part 5 and are not in addition to them.

This information is meant only as a general description to help you understand bodily injury coverages and available limits. It does not refer to any specific insurance policy and it does not modify the limits, terms and conditions of any policy you might purchase. To fully understand all coverages, including applicable limits and exclusions, you should read your policy carefully and discuss any questions with your insurance representative.

IntelliDrivePlus™

IntelliDrivePlus is a continuous driving program that uses a smartphone app to capture driving behavior and miles driven data, and adjusts your rate every policy term based on how and how much you drive. New Travelers customers who enroll could save on car insurance with an enrollment discount on the policy's first term. When the policy renews, safe driving behaviors can lead to savings of up to 30%, plus additional savings potential for lower mileage – while riskier driving and higher mileage can lead to higher premiums.

IntelliDrivePlus is available in 3 states: Arkansas, Nebraska, and Ohio.

After installing the IntelliDrive app on your smartphone, the app will automatically detect when you get into a vehicle and start a trip. The app will collect driving behavior and miles driven data for all drivers over the life of your policy. Your most recent driving performance and miles driven, and that of other enrolled drivers on your policy, will be used to adjust your insurance rate every time your policy renews. All eligible drivers on your policy must enroll in the IntelliDrivePlus program.

IntelliDrivePlus is designed to be more responsive to changes in how and how much you drive over time. It gives you more control over the price you pay by using your most recent driving behavior and the miles you drove in the prior term in determining your premium at each renewal.

IntelliDrivePlus captures information about your miles driven and driving behaviors associated with Braking, Acceleration, Speed, Time of Day, and Distraction. A map of your route taken during each trip, along with your driving performance to date, is available for review after each trip. Location information collected in the app is not used to determine your auto insurance rate.

Each driver's total miles driven and most recent driving performance is used to calculate your insurance premium every time your policy renews. Safe driving habits can lead to savings of up to 30%, plus additional savings potential for lower mileage – while riskier driving and higher mileage can lead to higher premiums.

Yes, each driver's app needs to capture at least 500 miles of driving during each driving performance assessment period. In addition, each driver's app needs to be on with permissions appropriately enabled for at least half of each miles driven assessment period.

If the app is not installed, Travelers will send reminder text messages to each driver who needs to install it. If the app is still not installed, we may remove all drivers from the program. Removing all drivers would affect your policy premium as your IntelliDrivePlus enrollment discount will be removed.

Yes. If you are not satisfied with the IntelliDrivePlus program for any reason, all drivers may opt-out of the program within 45 days of enrollment without impact to your policy, other than the loss of the enrollment discount.  After 45 days from enrollment, driving behavior and miles driven data from all drivers may affect your policy’s premium at renewal.
